This Privacy Policy (“Policy”) describes how Prernamart.com (“Platform”, “We”, “Us”, or “Our”) collects, uses, processes, stores, and protects personal information of users (“User”, “You”, or “Your”) who access or use the Platform, including through its website, mobile interface, or any associated services.

Prernamart.com is an initiative facilitated under the aegis of the Uttar Pradesh State Rural Livelihood Mission (UPSRLM) and supported by the Government of Uttar Pradesh, with the objective of enabling digital commerce and market access for Self Help Groups (SHGs), rural producers, artisans, and other independent third-party sellers (“Sellers”).

This Policy applies to all Users, including visitors, registered users, buyers, and Sellers, and governs all data collected through the Platform.

2. ROLE OF PLATFORM AND GOVERNMENT DISCLAIMER

The Platform operates as a technology intermediary that facilitates interactions and transactions between Users and independent third-party Sellers.

It is expressly clarified that:

  • UPSRLM and the Government of Uttar Pradesh do not independently determine the purposes and means of processing personal data beyond enabling the Platform’s functioning;
  • Sellers may independently collect and process personal data of Users, and such processing shall be governed by their respective privacy practices;
  • The Platform acts in a facilitative capacity and does not exercise control over third-party data practices.

Accordingly, neither UPSRLM nor the Government of Uttar Pradesh shall be liable for:

  • Data processing activities undertaken by Sellers or third parties;
  • Misuse, unauthorized access, or disclosure of data beyond reasonable safeguards;
  • Any indirect or consequential damages arising from data-related incidents.

3. CONSENT AND LAWFUL BASIS OF PROCESSING

By accessing or using the Platform, You hereby provide Your free, informed, specific, and unambiguous consent to the collection, use, storage, and processing of Your personal data in accordance with this Policy.

You acknowledge that:

  • Such consent is provided for lawful purposes connected with the functioning of the Platform;
  • You may withdraw consent at any time, subject to legal and contractual limitations;
  • Withdrawal of consent may result in limited or restricted access to the Platform services.

We may disclose personal data to:

If You request a password reset, Your IP address may be included in the communication for verification purposes.

However, no system is completely secure, and Users acknowledge inherent risks in internet-based data transmission. The Platform, UPSRLM, and the Government shall not be liable for breaches beyond reasonable control.

12. THIRD-PARTY DATA PRACTICES

The Platform does not control and is not responsible for:

  • Data practices of Sellers
  • Third-party websites or embedded content
  • External service providers

Users are encouraged to review the privacy policies of such third parties.

13. CHILDREN’S PRIVACY

The Platform is not intended for individuals below the age of 18 without supervision. The Platform does not knowingly collect personal data from minors.

If such data is identified, it may be deleted without prior notice.

14. INTERNATIONAL DATA TRANSFERS

Where data is transferred outside India, such transfers shall be conducted in accordance with applicable legal requirements. The Platform shall not be liable for risks associated with such transfers beyond reasonable safeguards.

15. GOVERNMENT NON-LIABILITY

UPSRLM and the Government of Uttar Pradesh shall not be liable for:

  • Misuse or unauthorized access of personal data by third parties
  • Data breaches beyond reasonable safeguards
  • Indirect or consequential damages arising from data processing

Their role is limited to facilitating the Platform as part of a public livelihood initiative.

16. GRIEVANCE REDRESSAL MECHANISM

In compliance with applicable laws, a Grievance Officer shall be designated, and their contact details shall be made available on the Platform.

Users may submit complaints regarding data processing, which shall be acknowledged and addressed within timelines prescribed under applicable law.

17. CHANGES TO THIS POLICY

The Platform reserves the right to modify this Privacy Policy at any time. Updated versions shall be published on the Platform, and continued use shall constitute acceptance of such changes.

18. GOVERNING LAW AND JURISDICTION

This Policy shall be governed by the laws of India. Any disputes arising in connection with this Policy shall be subject to the exclusive jurisdiction of courts located in Lucknow, Uttar Pradesh.
